About the Portfolio
Upaid’s patent portfolio encompasses certain foundational technologies underlying the majority of modern mobile commerce systems’ implementations. The portfolio includes enabling technologies for mobile commerce platforms, over the air top-up, as well as key pre- and post-paid mobile services.
The portfolio is always growing and is composed of more than 35 patents granted in Armenia, Australia, Azerbaijan, Belarus, China P.R., Eurasia, Georgia, Hong Kong, Hungary, India, Indonesia, Israel, Japan, Kazakhstan, Kyrgyzstan, Mexico, Moldova, Philippines, Russia, Singapore, South Africa, Taiwan, Tajikistan, Turkmenistan, Ukraine, United States, and over 1000 claims. None of the patents was acquired by purchase. All are the fruits of Upaid’s own inventorship.
Claims of the parent patents to all of Upaid’s worldwide portfolio have been construed in a US federal Markman ruling [Case 2:07-cv-00114-CE (Document 360)] and provide a solid demonstration of the breadth and pivotal role of these patents play in today’s mobile commerce.
In the US and the UK the patents were attacked as part of litigation. Upaid prevailed comprehensively in the UK where the attacking party lost on first instance and appeal; its application for further appeal to the House of Lords was denied. In the US--in Texas state courts and in the Federal Court of the Eastern District of Texas--the challengers sought to limit their liability by challenging the validity as well as the breath and meaning of all of the key claim terms. Virtually every effort was explored to undermine the portfolio. In the end, the opposing party settled and admitted to the media that they compensated Upaid with US$ 70 million.
Our litigation experience leaves us not only well resourced but confident in the strength of our portfolio. The experience also prepared us well to more easily and efficiently meet the demands of any future complex cross-border patent litigation.
